Telly Health, Inc. ("Telly Cares," "we," "us," or "our") provides a mobile application designed to support and empower caregivers. Because our platform allows you to securely share health updates directly with a patient's medical providers, Telly Cares operates as a "Business Associate" under the Health Insurance Portability and Accountability Act (HIPAA) on behalf of our hospital and clinical partners. This Privacy Policy outlines how we collect, use, protect, and share your information.

2. Information We Collect

We collect information that you voluntarily provide when using the Telly Cares app. This includes:

  • Account Information: Name, email address, and device IDs.
  • Location Data: Geolocation data to facilitate service delivery.
  • Caregiving Observations (Health Data): Physiological measurements (e.g., patient vitals and symptoms), medication and treatment records, and general wellness observations (e.g., Activities of Daily Living).
  • Consumer Health Data Distinction: Any health-related data logged prior to your explicit authorization connecting your account to a partner hospital's clinical team is governed by applicable state consumer health data laws, not HIPAA.

3. How We Share Information

We process and share your information strictly to facilitate care and improve our services:

  • Clinical Integration: With your explicit, in-app permission, your caregiving observations are shared directly with the patient's designated clinical team.
  • Internal Analytics: We may use fully anonymized, de-identified data for internal analytics to improve app performance and user experience.
  • No Sale of Data: We do not sell your personal or health data to third parties, data brokers, or advertisers under any circumstances.

4. Data Retention and Deletion

We retain your data for the active lifespan of your account and in strict accordance with the Business Associate Agreements (BAAs) executed with our hospital partners.

Requesting Deletion: You may request the deletion of your account and associated personal data at any time. We will respond to all verifiable deletion and access requests within 45 days.

Clinical Record Caveat: Any caregiving data already transmitted and integrated into a patient's official clinical medical record is subject to the retention policies of the respective hospital partner and applicable medical record compliance laws. We cannot delete data that has become part of a formal medical record.

5. Data Security

We implement robust, industry-standard administrative, technical, and physical safeguards designed to protect your private information from unauthorized access, loss, or misuse. This includes encrypting all health data in transit and at rest, conducting regular risk assessments, and requiring stringent data security contracts with all service providers.

6. User Rights

Depending on your jurisdiction (including California, Washington, Nevada, and New York), you have specific rights regarding your data:

  • Right to Know and Access: Request details about the categories and specific pieces of personal information we have collected.
  • Right to Delete/Correct: Request the deletion or correction of inaccurate personal information, subject to the clinical record caveat outlined in Section 4.
  • Right to Withdraw Consent: Revoke consent for the collection or sharing of consumer health data at any time.
  • Right to Limit Use of Sensitive Data: Direct us to limit the use of precise geolocation and health data solely to the purposes necessary for providing essential app services.

7. Age Restriction and Children's Privacy

Telly Cares is strictly limited to users who are eighteen (18) years of age or older. We do not knowingly collect personal information from minors. If we discover that a user under 18 has bypassed our age verification and provided personal data, we will immediately take steps to terminate the account and permanently delete the information from our active databases. We disclaim any liability for minors who fraudulently misrepresent their age to access the platform.

8. Changes to This Policy

We may update this Privacy Policy periodically to reflect changes in legal requirements or our data practices. We will notify you of any material changes via in-app alerts or email. Continued use of the app constitutes acknowledgment of the updated policy.
